Terms and conditions

Participation

These awards ("Awards") are conducted by Royal Flying Doctor Service ABN 80 009 663 478 ("the Promoter"), of 12 Casuarina Street, Brisbane Airport 4008.

Please direct any postal correspondence to the above address.

All nomination instructions and prize information published by the Promoter form part of these conditions. By nominating, nominees accept these conditions.

Competition nominations commence at 12:00AM on Tuesday, 31 October 2023 and close at 11:59PM on Tuesday, 12 December 2023 ("Nomination Period").

Nominations

To enter these Awards, an Eligible Nominee must, during the Nomination Period: Visit: http://rfdslocalhero.com.au/

Nominate their RFDS Local Hero ("Nominee") by registering at http://rfdslocalhero.com.au/; and Provide information about their Nominee as requested on the nomination form Nominations must be received by the Promoter during the Nomination Period.

Nominations will be deemed received at the time that the Promoter is satisfied that all necessary requirements have been met and not at the time of submission by the Eligible Nominee. The Promoter takes no responsibility for late, lost, incomplete, incorrectly submitted, illegible or misdirected nominations or delays or failures in any equipment or telecommunications service used to administer these Awards.

Cost of nomination via the internet is free, but internet connection and usage rates may apply.

Eligible Nominees should obtain details of such costs from their service providers.

Nominees can be individual people, families or groups.

Nominees can be only nominated in Queensland.

Nominees must be in good standing in the Community.

Each Eligible Nominee acknowledges and agrees that the Promoter (and each of its assignees and licensees) has the right, in its absolute discretion, to edit, amend, copy, reproduce, use, publish, broadcast and communicate to the public, the nomination in any media including television and the internet, without any further consultation, reference, payment or other compensation. Each Eligible Nominee also agrees that they will not make any claim against the Promoter (or its assignees and licensees) arising from the exercise of these rights, including claims in relation to any moral rights that they may otherwise have.

The Promoter may, in its absolute discretion, declare a nomination invalid or disqualify any nominee that tampers with the nomination process or benefits from such tampering, submits a nomination that is incomplete or not in accordance with these conditions, or otherwise acts in a manner that is disruptive, dishonest or calculated to jeopardise the fair and proper conduct of these Awards.

The Promoter reserves the right to require a Nominee to verify the validity of their nomination within the requested time, including but not limited to an Nominee's identity, eligibility, age and address and to disqualify any Nominee who does not satisfy any nomination criteria in these conditions. Errors and omissions may be accepted at the Promoter's discretion. Proof considered suitable for verification is at the Promoter's discretion.

Judging

Between 12:00AM on Tuesday, 5 December 2023 and 11:59PM on Tuesday, 19 December 2023 the Judging Panel will select the RFDS Local Heroes based on the nomination criteria.

Any additional costs not expressly stated, but which may be incurred in acceptance and use of a prize, are the responsibility of the RFDS Local Heroes.

Other than as expressly stated in these conditions, a prize is non-transferable, non-refundable, non-exchangeable, non-replaceable, and non-redeemable for another prize including cash, except at the Promoter's discretion.

Award Recipients

The recipients of the RFDS Local Heroes Awards will be notified by telephone within 3 business days of judging.

The nine RFDS Local Heroes will be invited to attend the 2023 Light the Lanterns: An RFDS Celebration on Saturday, 27 April 2024 at the Royal International Convention Centre, 600 Gregory Terrace, Bowen Hills, Brisbane.

Each RFDS Local Hero will receive two Light the Lanterns tickers, two return flights departing nearest domestic airport, 1 night accommodation at Rydges Fortitude Valley (directly across the road from the venue – 601 Gregory Terrace, Bowen Hills, Brisbane) or Alcyone Hotel Residences and 2 cab charge vouchers for transport to and from Brisbane airport.

The nine RFDS Local Heroes will automatically be nominated for the RFDS Queensland Hero Award with the award recipient to be announced in April, 2024.

The RFDS Queensland Hero will receive a $20,000 grant to improve health and wellbeing in their community. The RFDS (Queensland Section) team must approve (with negotiation) the RFDS Queensland Hero's plans for the $20,000 health and wellbeing grant.

Voting

Voting for the Queensland Hero Award will commence 12:00AM on Tuesday, 12 March 2024 and close at 11:59PM on Tuesday, 30 April 2024 ("Voting Period").

The decision of the RFDS Queensland Hero is final at remains the discretion of the RFDS. All decisions are final and the promoter will not enter into any discussion about the result.

Other than as expressly stated in these conditions, a prize is non-transferable, non-refundable, non-exchangeable, non-replaceable, and non-redeemable for another prize including cash, except at the Promoter's discretion.

General

If for any reason these Awards are not capable of running as planned, or is interfered with or disrupted in any way (including by vandalism, power failures, natural disasters, acts of God, weather event, civil unrest, strikes, computer bugs or viruses, tampering or technical failures), the Promoter reserves the right to cancel, terminate, modify or suspend these Awards, or invalidate any affected nominations.

The Promoter assumes no responsibility for: (i) any error, omission, interruption, or delay in the operation or transmission of any communication sent to (or by) the Promoter or any Nominee whether caused by problems with communication networks or lines, computer systems, software or internet service providers, congestion on any carrier network or otherwise; (ii) any theft, destruction or unauthorised access to, or alteration of such communications; (iii) any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of these Awards; (iv) any incorrect or incomplete information which may be communicated in the course of the administering these Awards (whether as a result of one of the foregoing causes or otherwise); or (v) any delay in delivery (when not directly caused by the Promoter or its supplier), or failure of safe delivery of a prize.

All of the Promoter's decisions in relation to all aspects of these Awards are final and no correspondence will be entered into. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

To the full extent permitted by law, the Promoter, its associated companies and agencies and any of their personnel (the "Relevant Parties") exclude all liability for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any Eligible Nominee in connection with these Awards or a prize, including without limitation: (i) any indirect, special, economic or consequential loss; (ii) any loss arising from the negligence of a Relevant Party; and (iii) any liability for personal injury or death. To the extent that such liability cannot be excluded by law, it is limited to the minimum allowable by law.

The RFDS Local Heroes must, at the Promoter's request, participate in all promotional activity (such as videography, publicity and photography) surrounding winning a prize, free of charge, and consent to the Promoter using their name, likeness, image and/or voice (including any photograph, film and/or recording of them) in promotional material in any media at any time without notification or compensation, financial or otherwise.

The Primary Supporter, Ergon Energy Retail (EER), has the right to assist the RFDS to develop video content relating to each RFDS Local Hero.

EER has the right to use all promotional content on their website, social media channels and in any other marketing related material to relation to the promotion of the RFDS Local Hero Awards or EER's existing partnership with RFDS Queensland.

Each Nominee completely releases Facebook from any and all liability in relation to these Awards, and acknowledges that these Awards are in no way sponsored, endorsed or administered by, or associated with, Facebook.

Privacy Statement and Marketing Consent

Nominee's personal information is collected from Nominees by or on behalf of the Promoter to enable the Promoter and its agents to manage, administer and promote these Awards and, where applicable, publicise the RFDS Local Heroes. The personal information may also be provided to persons assisting the Promoter, including prize suppliers and deliverers, marketing agencies and IT providers, media outlets and related companies. The RFDS Local Heroe's name will also be published at http://rfdslocalhero.com.au/ and www.flyingdoctor.org.au/qld/news. By participating in the Competition, Eligible Nominees consent to these uses and disclosures of their personal information.

If an Eligible Nominee does not provide the personal information the Promoter requests, the Promoter may not be able to enter them into these Awards. All personal information is handled in accordance with these conditions and the Promoter's Privacy Policy. Information about how to access or correct the personal information that the Promoter holds about you, or complain, can be found in the Promoter's Privacy Policy available online at https://www.flyingdoctor.org.au/privacy-policy/.

The Nominee consents to the retention of their personal information so that the Promoter and any related companies that use the Royal Flying Doctor Service brand ("we"/"us") may use this information from time to time to let the Nominee know about campaigns, news, and services they might be interested in (by any medium, including telephone, email, mail, SMS or online marketing). In order to carry out direct marketing, Nominee's personal information will be collected from and disclosed to others that provide us with specialised data matching, trending or analytical services, as well as general marketing services. We, and other people who provide us with services, may combine the personal information collected from Nominees or others, with the information we already hold about Nominees. We may also use online targeted marketing, data and audience matching and market segmentation to improve advertising relevance. Nominees may unsubscribe from marketing communications at any time using information contained in a marketing message or by making a request during a telephone call.
